If an Entry includes any of the prohibited elements listed above, the Entry will be disqualified, along with the entrant who submitted it. The above list is not intended to be exhaustive; the Sponsor and/or Administrator reserve the right to disqualify any Entry for any reason, in its sole and absolute discretion.
You must have a device that supports the Twitter® or Instagram® application. If you do not have a Twitter® or Instagram® account, sign up for a free account at Twitter.com or Instagram.com, follow the instructions and agree to its terms of use. If your account is set to “protected or private mode”, your submissions will not be received by Sponsor or Administrator, resulting in your failure to enter the Contest. Normal Internet access and data usage charges imposed by your online and cell phone service provider will apply.
Use of any automated system to participate is prohibited and will result in disqualification. Multiple entrants are not permitted to submit Entry using the same social account. If the Sponsor suspects that an entrant attempted to obtain additional Entries by using multiple accounts/identities or any other method, all Entries submitted by the entrant will be declared null and void, and the entrant may be disqualified from participation in the Contest at the Sponsor’s sole discretion. In the event of a dispute as to the ownership of any Entry, the authorized account holder of the Twitter® or Instagram® account used to enter will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an email address by an internet access provider, online service provider or other organization responsible for assigning the email address used to create the social account. Potential winner may be required to show proof of being the authorized account holder.
Sponsor will not confirm receipt of Entries. Sponsor is not responsible for any lost, late, misdirected, unintelligible, corrupted, inaccurate transmissions of or failure to receive Entry information through Twitter and Instagram platforms. By participating, you agree to abide by and be bound by these Official Rules (Official Rules can be found at www.rulespg.com) and the decisions of Sponsor, which are final and binding in all respects and not subject to appeal.
RIGHTS IN SUBMISSIONS: Sponsor reserves the right to post any Entry submitted in this Contest on its website, on any other website controlled by Sponsor, and on social media. The inclusion of an Entry in the Sponsor’s social media feeds or website(s) (including but not limited to Sponsor’s Twitter® or Instagram® feeds) does not indicate that the entrant who submitted it is a winner.
By entering the Contest, you grant Sponsor the non-exclusive, royalty-free, and irrevocable rights to use, reproduce, copy, publish, display, distribute, perform, translate, adapt, modify, any part of your Entry in other works in any and all media worldwide in perpetuity. You warrant that you have the sole and exclusive right to grant such rights to Sponsor and that the Sponsor’s reproduction, publishing, displaying, and/or other use of your Entry will not infringe on any rights of third parties, including, without limitation, copyright, trademark, privacy, or publicity. Furthermore, you agree to release and hold Contest Entities, Twitter®, Instagram®, their respective affiliates and subsidiaries, and the officers, directors and employees of each of the foregoing, harmless from and against any liability of any kind arising from or in connection with any use of your Entry or participation in this Contest.
Ties: In the event of a tie, the judges will re-evaluate the tied Entries according to the judging criteria until the tie is broken. In the event of further ties, the judging panel will make the final determination as to which Entry will win a prize.
Sponsor reserves the right to select fewer than 20 winning Entries if in its sole discretion, it does not receive a sufficient number of qualified Entries. Sponsor will not disclose the judging scores.
PRIZES: Up to twenty (20) prizes will be awarded. Each prize consists of an invitation to participate in a virtual meet and greet with the artist H.E.R. for up to one minute via Looped app, tentatively scheduled between October 16, 2020 and October 19, 2020 (subject to change). Winners must download the Looped app prior to the meet and greet. Instructions on how to participate at an appointed time and a special code to log in to the virtual meet and greet will be provided to each winner. If a winner is not available at the appointed meet and greet time, that winner will forfeit the prize. Winners must agree not to share the special code. Any attendees, other than the winners who have won the prize, will be removed from the virtual meet and greet. The virtual meet and greet will be recorded and the Sponsor have the rights to share the whole or parts of the recording on any media or marketing. If the artist is not available for any reason for the meet and greet, the Sponsor reserves to rights to reschedule the virtual meet and greet and/or substitute the artist with another artist. In addition, the Sponsor and/or Looped reserve the rights in their sole discretion to suspend or cancel winner’s participation during the virtual meet and greet due to inappropriate behavior or misconduct.
There is no retail value associated with any of the prize. Total retail value of all prizes: $0.00.
Prizes are not transferable or redeemable for cash. Any depiction of the prize is for illustrative purposes only. No substitution allowed except, at Sponsor's sole discretion, a prize of comparable value may be substituted. Prize will be awarded if validly claimed by October 15, 2020, after which no alternate winner will be selected, nor unclaimed prize awarded.
By accepting the prize, each winner grants the Contest Entities, the right to capture and publish/share photos/videos of the virtual meet and greet, in whole or in part, without additional permission, notification, compensation or consideration, unless prohibited by law, and in furtherance of the foregoing you specifically and irrevocably hereby grant to Contest Entities, and each of their respective affiliates and licensees the right to use and otherwise exploit such recordings with your name, voice and likeness (regardless of whether altered, changed, modified, edited, used alone, or used with other material in the Contest Entities’ sole discretion), in any and all media, now known or hereafter devised, in perpetuity, throughout the world, on website(s), mobile platforms and widgets owned, controlled and/or administered by Sponsor and/or any of their respective affiliates or licensees, and in any advertising or press coverage related to the foregoing.
HOW TO CLAIM PRIZE: Each potential winner is subject to verification and entrant’s full compliance with these Official Rules before a prize can be awarded. Potential winners will be notified on or about October 12, 2020 by the Administrator via Twitter® or Instagram®. To claim the prize, you will be required to provide your contact information to the Administrator within 24 hours of notification. Once the potential winner’s contact information is received by the Administrator, the Administrator will email an Eligibility/Publicity Release (“Release”) to the potential winner during business hours. Each potential winner will be required to complete and return the Release prior to participation. At the sole discretion of the Sponsor or Administrator, disqualification, forfeiture and the notification to an alternate potential winner may result from any of the following: [a] potential winner’s failure to respond to notification via Twitter® or Instagram® within twenty-four (24) hours after its transmission; [b] the failure of notification due to deactivation of the potential winner’s account prior to receipt of notification; [c] potential winner’s account is set to block notification from the Administrator or Sponsor; [d] potential winner’s failure to return the completed Release within twenty-four (24) hours after transmission; [e] email to the potential winner is returned undeliverable; [f] a potential winner’s failure to provide Sponsor with satisfactory proof of age, identity and residency, if required; [g] a potential winner’s failure to provide Sponsor with satisfactory proof that he/she is the authorized account holder of the account associated with the winning entry, if required; [h] a potential winner’s failure to provide any required additional information upon Sponsor’s request; and/or [i] any other non-compliance with these Official Rules.
In the event of any prize forfeiture by a potential winner, the Sponsor may, in its sole discretion, award or not award the forfeited prize to an alternate winner. Sponsor and Administrator are not responsible for the Twitter® or Instagram® function that may interfere with the winner notification.
LIMITATIONS: The Contest Entities do not warrant that access to the Contest or virtual meet and greet will be uninterrupted. Neither the Contest Entities, Twitter®, Instagram®, nor any of their officers, directors, shareholders, employees, agents or representatives (individually and collectively, “Releasees”) are responsible for: (a) Entries from persons residing, or physically located, outside of the 50 United States and the District of Columbia; (b) Entries that are altered, delayed, deleted, destroyed, forged, fraudulent, improperly accessed, inaccurate, incomplete, interrupted, irregular in any way, late, lost, misrouted, multiple, non-delivered, stolen, tampered with, unauthorized, unintelligible or otherwise not in compliance with these Official Rules; (c) lost, interrupted or unavailable networks, servers, satellites, websites, or other connection, availability, or accessibility problems arising in connection with or over the course of the Contest; (d) failure of personal mobile device and/or software and hardware configurations; (e) any technical malfunctions, failures, or difficulties, printing errors, clerical, typographical or other errors in connection with the administration of the Contest, the processing of Entries, or the offering or announcement of the prize (defined in Section 9) or in any prize notification documents; (f) any other errors of any kind relating to or in connection with the Contest, whether human, mechanical, clerical, electronic, or technical in nature; (g) the incorrect or inaccurate capture of information, or the failure to capture any information in connection with the Contest; (h) any changes to any Twitter® or Instagram® function that may interfere with the Contest or your ability to timely enter; or (i) damage to a user's system occasioned by participation in this Contest or downloading any information necessary to participate in this Contest; even if caused by the negligence of any of the Releasees.
Sponsor reserves the right to cancel, modify, or suspend the Contest at any time if fraud, technical failures, or any other errors or other causes corrupt the administration, security, integrity, or proper play of the Contest. In the event of Contest cancellation, Sponsor reserves the right to determine the winners from among all eligible Entries received up to the time of such cancellation, in a manner determined by Sponsor to be fair, appropriate, and consistent with these Official Rules.
This Contest is in no way sponsored, endorsed or administrated by, or associated with Twitter® or Instagram®. Any questions, comments or complaints regarding the Contest must be directed to the Sponsor, and not to Twitter® or Instagram®. Pandora is the Sponsor of this Contest. Pandora® is a registered trademark owned by Pandora Media, LLC and is used with permission.
All marks herein are the property of their respective owners who, other than Sponsor, are not sponsors of this Contest nor do they have any responsibilities regarding its conduct or administration.
